To the Honorable the judges of the Circuit Court of said County of Clinton in chancery sitting.
Humbly complaining your orator Jacob Stutler of the County of Clinton and state of Indiana shows to your honors that he has been a resident of the State of Indiana for more than five years last past and of the County of Clinton for more than five years last past and that your orator is still a resident of the said County of Clinton in the State of Indiana. Your orator further shows to your honors that on or about the (left blank) day of (left blank) in the year of our Lard Eighteen hundred and forty (left blank) your orator intermarried with one Ellen Stutler (whom your orator prays may be made defendant to this his bill of complaint) Your orator charges that said Ellen left and abandoned your orator more that two years since without the intention of returning to live with your orator and although your orator did everything in his power to induce the said Ellen to live with him and be a dutiful and affectionate wife. Yet sxx it may xxxxxx your honors that said Ellen has disregarded the kind entreaties of your orator. And imprudently(s) and indecently left the house and society of you orator and has since the time of her said elopement up to this time and is yet (which is more than two years) living with and cohabitating with other men to the great mortification and dishonor of your orator all of which is contrary to Equity and good censeiencir(?). In tender consideration thereof and in as much as your orator is totally without remedy in the premises by the strict rules of Common Law. Will your honors grant to your orator the state graxxx xxxx of subpoena. may the said Ellen be made defendant to this his bill of complaint. may she be compelled to answer all and singular(?) the premises(?) on oath and may your orator be divorced from the said defendant and the bonds of matrimony now subsisting between your orator and said defendant be dissolved and may your orator have such other and further relief in the premises as in Equity and good conscience he is Entitled and as in duty bound will ever may be

You are hereby commanded to summon Ellen Stetler if she may be found in your bailiwick to be and appear before the Honorable Judges of the Clinton County Circuit Court at the (?)spring term Thereof to be hxxxx at the Court House in Frankfort on the fourth Monday in April next 1846 xx and then and there plead answer or denxxx to a bill of chancery for a divorce filed in said County against her by Jacob Stetler and this she will no wise fail at her peril and have you then and there this writ
